Lemon was among a group of protestors who earlier this month entered a Saint Paul church where demonstrators believed an ICE agent was serving as pastor, The New York Times reported.
The Trump administration had sought to charge eight people, including Lemon, in connection with the incident, citing law that protects houses of worship from protest.
Lemon has argued he was not participating in the demonstration but covering it as a member of the media.
Instead of investigating the federal agents who killed two peaceful Minnesota protesters, the Trump Justice Department is devoting its time, attention and resources to this arrest, and that is the real indictment of wrongdoing in this case,” his attorney said.
